Branson man sentenced to 21 years for murder

BRANSON MO NEWS: A Branson man was sentenced Friday for murder.Dakota Claypole, 23, was sentenced to 21 years for second-degree murder and armed criminal action following the death of Daxton Drake, 22, at a residence on Rainbow Drive in January 2017. Claypole’s case had been moved to Greene County on a change of venue from Taney County. On May 4, Claypole pleaded guilty before Circuit Judge Calvin Holden, according to Prosecuting Attorney Jeff Merrell.“Specifically, Judge Holden sentenced Claypole to 21 years in the Missouri Department of Corrections for second-degree murder, 21 years in the Missouri Department of Corrections for armed criminal action, with the sentences to run concurrently with one another,” Merrell stated. “The class A felony of murder in the second degree carries a maximum penalty of 30 years or life imprisonment – with the possibility of parole. The unclassified felony of armed criminal action carries a minimum sentence of three years in prison, with no maximum.”

Court documents state Claypole took a 9 mm handgun from a gun case in the downstairs area of a home on Jan. 16, 2017. He told police he loaded a magazine into the gun and loaded a round in the chamber as he walked upstairs. Claypole told police he wanted to scare Drake, according to court documents.According to Merrell, a witness – who was romantically involved with both Claypole and Drake – told police that she and Drake were in bed together when Claypole walked up the stairs leading into the bedroom, and brandished a handgun. (In a social media post, the witness described Claypole as her “ex.”) Claypole verbally confronted Drake and fired a gunshot in his direction. Then, Drake stood up and Claypole fired multiple gunshots into Drake, killing him.Court documents state Claypole then left the handgun on the bed and took keys belonging to the witness.
