BRANSON MO NEWS: In a case involving a professor who wanted to carry a gun on MU’s campus, a Boone County Circuit Court judge ruled Wednesday that the campus ban on firearms doesn’t violate state statute.The case dates back to 2015 when MU School of Law professor Royce Barondes sued the University of Missouri System over its policy prohibiting the concealed carry of firearms.

The passage that is disputed by both sides — the sixth subsection of the statute — states: “Notwithstanding any provision of this section to the contrary, the state shall not prohibit any state employee from having a firearm in the employee’s vehicle on the state’s property provided that the vehicle is locked and the firearm is not visible.”Judge Jeff Harris wrote in his ruling that “the (UM Curators’) Rule does not conflict with and is not invalidated by Section 571.030.6.”Harris goes on to say that the statute only addresses criminal conduct, not what the UM System “can regulate as a civil matter on their own property.”While the statute says the state “shall not prohibit” firearms in vehicles, it doesn’t say whether other entities can prohibit with their own regulations. Because of this, Harris decided the UM System is not in violation of the statute.However, the question of whether the school’s firearm policy violates the state constitution will be decided at a later date, Harris wrote in his ruling.Barondes said he was happy the constitutional question will still be considered.
